Okay I got a what the fuck is wrong with people scenario...

In my life, I make the full effort to conduct myself in a way to take the path of least resistance, reduce incoming bullshit coming my way and protect my ass while having all details exact and bases covered. This is how I am, and surely not lazy or idle about doing this in every endeavor.

I don't like to waste time cleaning up my own messes if I could have done better by having avoided them. So I do my best from the onset and with overkill to insure...the state of no bullshit...and learn from experience and misjudgments or mistakes as I go along. My ignorance or error is my fault and my responsibility to handle and learn from.

But sometimes, even with your best logical, systematic and thorough efforts...someone...and their idiocy...has to get in the way.

A personal story for the forum of what occurred for me today.

For the past three months, my wife and I have been planning to do a complete gutting and renovation of our main bathroom. The house is about fifteen years old. We designed and picked out everything we wanted and decided to spend good money, not do anything ourselves and have local reliable contractors do everything. Normally I would do as much as I could on my own to save, but my time is more valuable seeing how she is pregnant and feeling fatigue which limits her help. So I have the cash and don't mind. We went with mid-priced fixtures, tiles, tub and shower, floor heating..etc. Not high end or low end. We got the estimates, talked with tiler, plumber, electrician and supplier who are all working together as a team from one of the most reliable local places with an excellent reputation for good work and honoring warranties. Everything was ready to go. They just needed the word from us when to start. In Norway, bathrooms are extremely expensive...about five times more than what I would pay in the U.S. and we are talking about a total bill of $50,000 U.S. dollars. This is not chump change.

My wife and I then revisited a vital topic that had been brought up before when we first discussed getting a new bathroom. And that was foreseeing and preparing for the potential unexpected. I have experience with bathrooms, as does my wife, and she is quite handy and has done a half dozen bathrooms over the course of her life. My concern was that there is always a chance that when you tear down tile and wallboard that there will be hidden water damage and possible mold and fungal growth. This can be hard to know until you tear down the wall and the damage can be extensive and expensive. We don't know if there is damage, but we want to avoid surprises and...potential bullshit.

Even the contractors have told us, on their own initiative, that before they break into a wall, it is a good idea to call the insurance company and get advisement on being covered for potential water damage, mold and fungus. We agreed and mentioned we already discussed it. But they did inform us that once you do break a wall BEFORE checking with your insurance company and then after find mold...they will not cover a claim. Good tip, but I knew this as it is quite universal.

So, my wife informs me that she will call the insurance company that we use for your home insurance and let them know what is going on with the bathroom and get the information on how to proceed before the walls are torn down. She specifically is calling to address that before breaking into the wall that we are concerned about the potential problems that may arise and that we want to be in full compliance with being able to make a claim should something be found. Specifically, water damage and resultant mold and/or fungus.

The insurance company employee, over the phone, after hearing the above paragraph as to our intentions, advises my wife that, "You can tell your contractors to start tearing down the walls and if they find anything, then call us and we will send someone out from the company to assess the situation and start any claims process".

So...WE GOT THE GO.. from the insurance company. And it's on. The contract also contains that the job is to be completed in no more than six weeks, which is one week longer than the contractors told us they would need. I am generous...what can I say. Now I have imaginings of bathing in my luxurious tub with bubble bath and candles while my wife strokes the Big Benjamin with essential oils to my delight and ecstatic joy. Because that's all we really want in life is delight and ecstatic joy...Right??? Are ya' with me on that one gang?

So, we give word to the contractors that they can start, which was today. The come in and remove the shower, tub sink and storage units and begin hammering away at the walls to bring down tiles and wall board.

The mold and fungus growth is the most extensive I have ever seen. It is not from leaky plumbing, but from using a plastic liner over insulation which is over a concrete wall. This part of the house, the ground floor is actually imbedded in the earth. And when plastic is used behind the wallboard it traps moisture and this growth occurs. Come to find out many houses constructed in the late 1990s that are this style have the plastic and have this problem. So this means there is a run of wall in other rooms that are affected that are about six times more area than just the bathroom. We are talking major fucking work. No one would have known...but are we happy that we have all the bases covered and not only that but some things in other rooms we want updated will now probably have to be covered by the claim. Bonus.

My wife calls the insurance company as directed if we were to find any problems. She informs them that we have some problems and to please send the person out to assess the problem so we can make a claim. As has been discussed prior and we were given the authorization to proceed.

Are you ready for this???

The insurance employee on the phone, another person than who we spoke to before, says..."Your current policy doesn't cover mold and fungus and therefore we won't cover the claim." "If you had the next level of upgraded insurance this would be covered." "Have a nice day."

My wife is stunned and says good-bye just so she can sit with this bomb for a moment and decide the next move.
She later tells me...and I am now ready to go Uni-Fucking-Bomber on some insurance company ass.
My mind never stays relaxed at the initial news of my ass being fucked...no matter how much Taoist philosophy I have digested.
My ass is made for shitting...nothing more.

Now, it would appear that the "Your not covered and need more insurance" comment would have been the first thing we were told when we made our first call to the company to assure we would be able to make a claim. Instead of..."Yeah, go ahead and knock her down and give us a call...and we got your back." As now knocking down the wall and finding mold would prevent us from having said something wise and sensical as, "Oh, our present insurance will not cover mold and fungus if we knock down a wall? Ok, then we would like to purchase the upgrade that does cover it before we knock down the wall just to be on the safe side".

I mean isn't that why we were calling in the first place? To get advisement that any unforeseen problems would be covered by our policy before we start the work and put ourselves in a position where we would not be able to make a claim?

I am presently sharpening my knives and loading some clips. As I am about to make small trip tomorrow to the home office for some coffee, cakes and good times.

Should you see me on the news covered in blood and firing hot rounds into the crowd as they call me a lunatic killer American loose in Norway smoking people wearing casual suit jackets in an insurance agency, then I just wanted to let you know that is was nice to have known you all on the forum and that I am going out with barrels blazing.

I should have told my story earlier dammit! I had the run around with medicare and was going to mention that even if you have insurance or anything like that, you most likely are not covered and have to get into details with the bastards!! Boy did I complain when I found out a family member paying the premiums all this time and not being covered for squat!

When that chick said oh go ahead call us!! NO NO NO, that still doesn't mean you are covered, you have to say will YOU COVER this and so and so specifically and record it if you have to. They might say that your wife's question was too vague because you can't get a direct answer from it and of course the chick knew that and could get away without answering fully. If you think about it, if you ask if you found something could I make a claim for water damage and such, yeah of course you can, but the insurance may not cover it. So that's where they got you.

I would go back on your original insurance papers you have a look to see what it covers. And then just to make sure call the insurance company and pretend you are a new customer and ask them for the same insurance you have and then sneakily ask if it covers mold and such and if they say yes then they are in trouble bigtime!
Also there might be lawsuits already in place for plastic causing mold, because that is a health hazard, I know over here something similar happened and the makers had to repair and fix it all because of that.

Try to stay calm. I hope things work out.

Regarding the damp problem , yeah a total bummer, ive had my history with dealing with completly misleading ignorant assholes in these large companys / corporations

about 15 years old, the plastic liner sounds like a standard moisture barrier around bathroom , in uk usually you have the timber frame, then a plastic sheet on that, then the plasterboard screwed onto the timber frame with the plastic liner at its back , then insulation behind that .

Then if their tiling onto the platerboard, it must first be coated with a waterproof adhesive like pva before tiling ( dont know if your wallboard is "plasterboard" or some form of wood sheet but wouldnt matter same principle i expect)

My questions would be where has the damp entered the cavity from ?
Is it coming from the bathroom ?
or coming in from outside ?

Has the bathroom been renovated by some cowboy before u purchased the house ?
Or is the bathroom standard spec from new ?

Are the cavitys ventilated ?

The first thing to do is establish where the moisture has been entering

If the house is in new spec condition, then that is a build design fault and any upstanding insurance should cover that , itherwise whats the point of having "buildings insurance cover"
If it is a design fault, i would go to town on the original building company, the insurance company as far as the legal system allows and the newspapers without spending money on that off course.

The other possibility is that its a problem caused by a cowboy contractor doing poor work or a lack of maintennance somewhere on the building .

JUst a few thoughts. but let us know what caused it when you confirm

Chinese Drywall Lawsuits

As of March 10, 2009 six class-action lawsuits had been filed in Florida on behalf of more than 2,000 homeowners in that state who claim their homes are eroding because of contaminated drywall. Miami-based Lennar Corp., one of the largest homebuilders in the United States and California, has been named as a defendant. Lennar Corp. has subsequently filed suit against numerous U.S. drywall manufacturers, which reportedly ordered drywall made in China and then shipped it into the US.

In June 2009, the U.S. Judicial Panel on Multidistrict Litigation (MDL) consolidated many lawsuits regarding Chinese-made drywall installed in U.S. homes. According to masstortdefense.com, the motion for consolidation encompassed ten actions, four of which were in the Southern District of Florida, three actions in the Middle District of Florida and one action each in the Northern District of Florida, Eastern District of Louisiana, and Southern District of Ohio. The MDL panel said it knew of 67 related lawsuits that were pending in federal courts around the country.

Q. that's just one of many cases of the bad gypsum for wallboard being imported from China. And people are getting compensated. The case I heard about was some other kind of defect with the wallboard.

I would find out what it is made out of just in case it's not the plastic causing the mold. Good Luck.

Yes, the moisture was coming from the outside.
As the first floor of my home is embedded halfway into earth almost like a basement, then I have two stories on top of this.
Until 1997 they were trying this style of home and did not get it right in many homes.
So sufficient barrier was needed outside to prevent moisture from coming through concrete foundation walls for first floor.

But after a few more obfuscations, misrepresentations and outright lies to now cover their huge mistake, I have now rectified this situation.
I went up the ladder a bit with reps in the insurance company and the story altered a bit as to why I would not have been covered for this, but they were not addressing the mistake of the first rep. So I had them give me all their policy options and policy rules copied on paper. After an intense perusal, I could see that what I was being told verbally was not accurate with what was in writing. As an outsider in Norway I am entitled to one hour a month of free legal advise from the community attorney.

I stopped by the attorney's office and in twenty minutes we decided that they fucked up and that they were not correctly interpreting their own rules regarding policy coverage. He wrote a letter and now the ball is rolling. The Insurance company will be covering repair to damages not only inside the house, which is all I was requesting, but now must pay to dig a six foot deep trench around the outside of my house and insulate it properly. That calls to take down my huge terrace or deck...which they are also going to have to replace with an upgrade to get it up to modern code.

See mutha' fuckaz' you try to take...and you get taken.
The guns are back in the closet...situation downgraded from red to yellow.
They should learn to be more careful in the future, cuz' we American are known to make up reasons to kill someone for our amusement.

Damn...a good joint would be nice right now to celebrate my victory. I guess a mango and strawberry fruit smoothie will have to suffice.

Do what the big insurance companies out of the City of London
do, qsc, and have been doing for hundreds of years.

Buy a huge insurance policy and then get it reinsured as an
investment where there are investors and holders on the
insurance. Then, hire a team to blow the entire fucking block up
offering them payment through the insurance scam.

They need to film the destruction though otherwise payment might
be difficult, after all, they need to prove the destruction. If this gets
complicated, take out what's called a 'catastrophe bond' where there
are investors in and insurers of the bonds. The reinsurers out of
London like Lloyd's for example, will have their agents wage or hedge
the bond based upon risk of your property.

Some will bet there is no destruction and others will invest because
they see a good investment strategy. Then, put the word out for a good
sabotage, assassination and deception team to take care of the destruction
thus favoring investors on the catastrophe bond which would be the winning
side of the bond.

Then sit back and watch the entire property go up in a huge blast. Oh, one
more thing, just make sure your books are stored in a solid blast proof
container, I don't appreciate books frayed or with burnt pages.
